Form 26: Campaign Disclosure Statement GUIDE

Please use the guide when completing your Campaign Disclosure Statement. The Form has been formatted to complete some auto-calculations. But you MUST insert the numerical information correctly, or the form will not work. 

Completed and signed Forms may then be submitted to the Returning Officer at the Town of Peace River: 9911 100 Street (Box 6600), Peace River, AB, T8S 1S4 or legislativeservices@peaceriver.ca 

Information required on Form 26 includes:

• Total amount of individual, union, or corporate contributions of $50.00 or less.
• Total amount of individual, union, or corporate contributions of $50.01 and greater. 
• Total amount of the candidate’s own funds, not reimbursed from the campaign funds.
• Total net amount from fund-raising functions. For details on what is eligible from fund-raising functions, see LAEA section 147.31.
• Total amount of campaign expenses incurred in the year.
• Additional documentation on contributions, expenses, amendments or a review engagement report, if applicable.
• For a full list of what is required to be included on Form 26, candidates should see section 147.4(4) of the LAEA. 

Don’t forget, non-monetary donations need to be assigned a monetary value and be included in this reporting.

Any candidate who has a campaign surplus or deficit should consult the LAEA. 

The municipality is also required to make the campaign disclosure statements available on the Town’s website (s. 147.4(7)).

If you do not file a Disclosure Statement you may be fined, and you may be ineligible to run in the next general election (LAEA, s. 22(1)) or disqualified as a sitting Councillor (Municipal Government Act, s. 174(1)(b.1)).

Late filing fee

LAEA s. 147.7(2):  A candidate who is required to file a disclosure statement under section 147.4 and fails to file that document by the filing deadline must pay a late filing fee of $500 to the relevant local jurisdiction (Town of Peace River).

Non-compliance report to Town Council 

LAEA s. 147.8(1):  Subject to section 147.7, if a candidate fails to file a disclosure statement as required by section 147.4 
(a) in the case of an election of municipal councillors, the secretary shall 
(i) present a report to that effect to council on the day of the first council meeting after the filing deadline, and 
(ii) publish the report or the information in the report on the municipality’s website by no later than the day referred to in subclause (i), 

In other words, if your disclosure statements are filed after the deadline your name will be listed in a non-compliance report provided to Town Council and posted on the Town's website. 

Future eligibility impacts

LAEA s. 22(1.2): (1.2) A person is not eligible to be nominated as a candidate for election as a councillor or a trustee if 
(a) a report was presented or transmitted under section 147.8(1) in respect of the person, 
(b) the Court did not dispense with, or extend the time for, compliance with section 147.4 by an order under section 147.8(3), and 
(c) subject to subsection (1)(d.1), nomination day for the election occurs within 
(i) the 8-year period following the day on which the secretary presented the report to council or transmitted the report to the school board, or 
(ii) where the disclosure statement required by section 147.4 has been filed with the secretary, the 3-year period following the day of filing, 
whichever period expires firs

What does this mean? You will also not be eligible to be nominated for council for a period of (whichever expires first):

• eight (8) years following the day on which the report was transmitted to council, or
• three (3) years following the day of disclosure statement filing.

If you are listed in the non-compliance report, you may apply to the court for relief within 60 days of the day the report is made public.

In accordance with the Local Authorities Election Act (s. 147.4(2)), "[o]n or before September 30 of a year in which a general election is to be held, a candidate who has received contributions in the period beginning on January 1 and ending on July 31 of that year must file a disclosure statement in respect of that period. "

All candidates were asked to file Disclosure Statements evidencing compliance with this section; however, only those who met the criteria (i.e. received contributions (including self-funded contributions) during this period) were required to file by September 30. The disclosure statements are otherwise informational.

In accordance with the Local Authorities Election Act (s. 147.4(1)), "[o]n or before March 1 of each year, a candidate who has received contributions in the previous year must file a disclosure 
statement in respect of the previous year."

The section will be updated periodically, as statements are received.

In accordance with section 147.4(7) of the Local Authorities Election Act (LAEA), the local jurisdiction is required to ensure that all filed Campaign Disclosure Statements are made publicly available on their website. 

As further required by the LAEA, candidates for the 2021 General Election were required to file their campaign finance disclosure statements on or before March 1, 2022.

For full transparency, the Town is including the Campaign Disclosure Statements filed in relation to the 2021 Election. Redactions are applied in accordance with the LAEA.
